Federal Appeals court upholds Maryland assault rifle ban

quote [ A federal appeals court upheld Maryland's ban on assault rifles, concluding that the powerful military-style guns outlawed by the measure are not entitled to protection under the Second Amendment.

The 10-4 ruling, issued by the entire Fourth Circuit Court of Appeals in Richmond, reverses a decision by a smaller panel of judges from the court last year that called the law's constitutionality into question.
...
The law, which also outlawed magazines capable of holding more than 10 rounds, was challenged by two men who said they wanted to buy the banned rifles and by a handful of gun stores and associations. They argued that the rifles were popular among gun enthusiasts, used by people to defend their homes and not inherently dangerous. ]

Politics because guns=politics.

This looks like a well-written law, might even survive the Supreme Court.

not inherently dangerous.?

Doesn't sound like they're doing the job they were created for then.

Quite.

Ar15 was put out by colt as a sporting rifle. Same look as the m16 at the time. But an m16 is a machine gun. Put the selector all the way and it keeps firing while the trigger is pulled. Ar15s shoot one bullet every time you pull the trigger. So it could be argued that the original design for the m16 was military and killing people. And the original design for the ar15 was sport and therefore not killing people but shooting targets or hunting.

Sorry. Not a gun nerd.

M16 doesn't have full auto, it has "burst". You set selector switch to burst, it'll fire 3 rounds at one trigger squeeze, not all the rounds in the magazine.

Reverse the polarity of the tachyon array!

If you that's technical, you should hear me describe the equipment I actually use to do my job.

The original design for the Colt AR-15 was the ArmaLite AR-15, which was, according to Wikipedia, "designed above all else to be a lightweight assault rifle." ArmaLite sold the design to Colt in 1959 and the U.S. military began using a modified version called the M-16 in 1964. Shortly thereafter, Colt began selling a semiautomatic-only version, branded as the AR-15, for civilian use.

MAryland... Not surprised at all.

However, if it does make it to the SCOTUS and the plaintiffs win the case, it will negate the New York SAFE Act and similar controls in California and CT, etc.

I'm not sure which way Gorsuch would vote on this. NRA likes him, but seems unclear why.
King Of The Hill said @ 8:24pm GMT on 22nd Feb
He tends to be moderate on many levels but I think the NRA likes him as he views the constitutional aspect of the 2nd quite literally something not to be fucked with.
zarathustra said @ 11:15pm GMT on 22nd Feb
Yeah, but can they count on him to ignore the "well regulated" part.
Ussmak said @ 11:33am GMT on 23rd Feb
It's the militia that's supposed to be 'well regulated.' Not the arms.
zarathustra said @ 12:00pm GMT on 23rd Feb
And the reason people can have arms is to be in a well regulated militia, not just for shits and giggles. There would be no reason to add that qualifier if it wasn't to allow limitations.

funny how i set my fully loaded M-4 on the front porch and it failed to kill anyone all day! Maybe because the weapon does not kill, in the words of GySgt Hartman from "Full Metal Jacket" "It is the hard heart that kills" or the right hand gripping the pistol grip and the index finger squeezing the trigger!

Ever since the Travel Ban went in to effect i've been looking at local gun shops online. Oregon has some pretty lax rules, which explains both why those fuckwits were allowed to roam around occupying federal lands and not be prosecuted, and why I can consider ordering an AR-15 from multiple manufacturers. I am leaning towards the Tavor though, or possibly a Kel Tek. I was definitely looking at an M3 as well, since watching "The Accountant". Out of my price range though.

Suffice to say, the current administration has totally changed my views on these discussions of arms controls. Thanks, Obama.
Ussmak said @ 11:36am GMT on 23rd Feb
Just get the AR. It shoots better than the Tavor, is far less expensive, and has an aftermarket of parts that is on the same level as Harley Davidson motorcycles.

The Kel-Tec is an alright choice, if you can find one that's not marked horribly above MSRP.

I had visions of Matrix-level armoury in my garage, but then i'd have to move the wine fridge...

But yeah, if i'm going to drop 5k on gear, I might as well get several items vs one bullpup. Thoughts on brands / makes? Was looking at bushmaster, but reviews are they use a different supplier and are now crap. Seems Colt is the defacto goto?

Guns don't kill people. Bullets kill people.
backSLIDER said @ 8:46am GMT on 23rd Feb
Just my usual note about blah "high powered" 5.56 is an intermediate rifle cartridge. An ar-15 shares a lot of parts with the m4 (the military rifle) but is functionally different. There is no functional difference between a Ruger mini-14 and an Ar-15 but they have never had restrictions here in California except the same magazine bans for 10 rounds.

There are some key phrases that are always used by reporters that are are very anti gun. They are used in every single report I have ever read.
