When Should You Talk to the Police?

quote [ I recently heard Professor James J. Duane talk about the perils of talking to the police. He was accompanied by a former police officer. This is some of what he had to say in my continuing education program. ]

I remember that. And my surprise when halfway through he turned the stage over to the police officer who basically said "He's right."

The most bullshit thing about the Miranda rights is that you can't just exercise them by being silent, you have to out loud say, "I am exercising my right to remain silent". I can't think of any other major rights that require you to verbally invoke them.

I've always wondered about this. What happens if you just remain silent? Our if you just become a broken record and just say that you want a lawyer over and over? Anyone know?

A prosecutor can portray your silence as a sign that your guilty, or that you're showing indifference to victims. Unless you specifically invoke the right, using specific legal magic words.

This also only applies IF they prosecute you. They can shoot you, then interrogate you in the ambulance as you bleed out, and that's fine, so long as they're not using your statements to prosecute you.
