Yeah, what the fuck? I always thought maritime law basically boiled down to "whatever the fuck is happening on land, we as humans will always band together to defend one another against the hostile seas." If we can't even agree on the basis of no motherfucker deserves to drown just because they boarded ship in a country you don't like, then civilization is fucked.

Morally, I agree. I do think the law will distinguish, however, between the duty not to pass a drowning person with out giving them aid and setting out to look for drowning people you assume to exist and then claim a pass because of your intentions.

Isn't that what Search & Rescue teams do? Go out and find people they have reason to believe are drowning in the water? They're universally lauded as heroes. Frankly, it seems like the defense for Pia Klemp has a pretty straightforward argument to make.

Search and rescue are usually alerted that there is someone in distress. They don't just assume someone is and then go looking for someone who fits the bill.

Meanwhile, in Italy, Pia Klemp is getting ready to stand trial for helping to rescue more than a thousand migrants who were at risk of drowning as they tried to reach Europe. Klemp faces up to 20 years in prison if she is convicted of helping to aid illegal immigration.
