Jury In San Francisco Finds Accused Killer Of Kate Steinle Not Guilty Of Murder

quote [ A jury in San Francisco has found Jose Ines Garcia Zarate, a homeless undocumented Mexican immigrant, not guilty of murder in the death of 32-year-old Kate Steinle two years ago in a case that became a flashpoint in the national debate on illegal immigration.

As a presidential candidate, Donald Trump cited the Steinle killing as a justification for his intended crackdown on immigration. ]

@Fox, CNN, ET-al, the comments are mostly "this is what the damn liberals want" or "this is why we elected Trump!", or some variation of. It's a weird way for me to thank SE and it's community who mostly aren't too partisan for rational conversations.

Now is not the time to talk about immigrant control and bring politics into this. My thoughts and prayers are with the Steinle family.

“I think one of the things that we don’t want to do is try to create laws that won’t create — or stop these types of things from happening,” said White House spokesperson, Sarah Sanders.

Side note, i love that thoughts and prayers is now a meme

Don't worry. No one would expect you to understand prayer.

This was basically a textbook case of DA overreach from the beginning.

Zarate's defense, was, he found the gun under the bench wrapped in cloth, and it accidentally went off and killed a bystander. There was no evidence to really dispute that. The DA knew that and STILL went for the murder charge. Had he gone for negligent homicide, he would have had a much better chance at a conviction.

And candidate-trump® using the whole case as justification for an intended crackdown on immigration was really the wrong wagon to hitch that star onto. An hours research into the case by any halfway competent lawyer would have figured that out for him.

Oh, so, very true. But you have to admit this case did seem like a gimme to a DA: "Illegal kills white lady!" The facts are too often secondary to a DA.

Cooler heads prevailed, but now he's the new Willie Horton for trump®.

Dumpster still thinks the central park five are guilty. Despite DNA evidence and a confession to the contrary.

Plays great to the press. Mention that he is an illegal immigrant to the jury and you are looking at a mistrial.

Actual facts are irrelevant at this point.
Fish said @ 5:58pm GMT on 2nd Dec
Actual fact is that DOJ wants him. He woulda been better off pleading to manslaughter.

Now he's the poster boy for Trump's 'deport the illegals/build the wall' mantra.

What does this quote even say.

The irony is that had Trump not made such a big deal of this case he would have likely been convicted.

Without the attention Zarate would not have acquired the top tier pro bono defense attorneys with a passion against Trump to cast reasonable doubt. I also imagine that, being San Fran, the DA probably didn't put it's A team on the case either.
knumbknutz said @ 8:38pm GMT on 1st Dec
That's a very good point.
Fish said @ 6:01pm GMT on 2nd Dec
At this point, the point is moot; Sessions has him in the crosshairs now. As I mentioned above, Zarate would have been better off pleading manslaughter; now he's going to bear all of the cultural angst of the anti-illegal movement.

No politicization here. Nope.
DOJ files arrest warrant for illegal immigrant acquitted in Kate Steinle case
ICE Deputy Director Tom Homan added, "San Francisco's policy of refusing to honor ICE detainers is a blatant threat to public safety and undermines the rule of law. This tragedy could have been prevented if San Francisco had turned the alien over to ICE, as we requested, instead of releasing him back onto the streets."

the statement is factually correct, but ignores the idea that, assuming the testimony was true, there was a loaded pistol stolen from a local Parks Ranger wrapped in cloth under a bench, which could have been handled by someone else, in another crime.

having said that, on one hand I understand that his prior crimes were all non-violent, but he certainly wasn't going to stay deported, regardless of what ICE did, so having the local DA set him loose seems reasonable. On the other hand, criminals should not be set free in the case they are not in the country legally, regardless of their skin color or likelihood to re-offend. This guy is not a "dreamer" or defacto American that has no history outside the US, he was a Mexican citizen with a history of deportation, and IMO, for "sanctuary" cities to treat someone like this the way a law abiding, contributing (but illegal immigrant) person would be undermines the credibility of the "sanctuary" ideal.
Fish said @ 6:03pm GMT on 2nd Dec
Blah blah blah.

If he was in federal prison for immigration offenses, Kate Steinle would still be alive.
